1. Acceptance and Account Creation
MakerMind is operated by MakerMind, LLC, a Colorado limited liability company. By creating or using a MakerMind account, you agree to these Terms, the Privacy Policy, and any product-specific beta conditions shown during signup. You are responsible for accurate account information, lawful use of the service, and keeping your login credentials secure. If you use MakerMind for a business or other entity, you represent that you have authority to do so.
2. Beta Conditions
MakerMind is pre-release software. Features may change, be interrupted, contain defects, or require additional configuration. Beta access is provided for evaluation and studio operations support, not as a guarantee of revenue, legal compliance, inventory accuracy, tax treatment, shipping performance, or marketplace availability.
3. Studio Data and User Content
You keep ownership of the product, inventory, order, customer, image, copy, and business data you enter into MakerMind. You grant MakerMind permission to host, process, transform, and display that content only as needed to operate, secure, support, improve, and provide the service.
4. AI Outputs and Business Judgment
AI-generated plans, product copy, forecasts, cost analysis, marketing drafts, and assistant responses are suggestions. You must review outputs before relying on them, publishing them, making purchases, changing prices, shipping orders, or making business decisions. MakerMind does not replace professional legal, accounting, tax, safety, compliance, or regulatory advice.
5. Integrations and Third-Party Services
Marketplace, payment, carrier, email, AI, and analytics integrations depend on third-party services such as Shopify, Etsy, Square, Stripe, USPS, UPS, FedEx, Google, OpenAI, Gemini, Resend, and Supabase. MakerMind is not responsible for third-party outages, approval delays, policy changes, rejected credentials, rate limits, fees, data returned by those services, or actions taken inside those accounts.
6. Subscriptions, Trials, and Billing
MakerMind beta includes a free 30 day trial unless MakerMind states otherwise in writing. Paid access is currently $19.99 per month after the trial. Paid features may require an active subscription or valid beta access code. Payments, cancellations, taxes, and subscription changes are handled through the billing provider shown at checkout or in account settings. Unless required by law or stated in writing by MakerMind, fees already paid are not refundable.
7. Acceptable Use
You may not use MakerMind to violate laws, infringe rights, send spam, mislead customers, publish unlawful claims, upload malicious code, scrape or attack the service, expose secrets, or interfere with other users. During beta, MakerMind is not intended to be the official compliance system for regulated product safety, labeling, claims, recalls, medical data, payment-card storage, controlled substances, firearms, cannabis, alcohol, child-directed services, or other regulated uses unless MakerMind signs a separate written agreement supporting that use. You are responsible for product claims, safety statements, ingredient disclosures, allergens, shipping promises, marketing disclosures, marketplace compliance, and customer communications you publish.
8. Availability, Support, and Account Changes
MakerMind may update, limit, suspend, or discontinue beta features to protect users, comply with law, address security issues, or improve the product. We may suspend or terminate access for misuse, unpaid fees, security risk, or material Terms violations. Support may ask for diagnostic information, but will not ask you to expose provider secrets in chat or email.
9. Disclaimers and Limits of Liability
To the maximum extent allowed by law, MakerMind is provided as is and as available. MakerMind disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. To the maximum extent allowed by law, MakerMind will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages.
10. Changes and Contact
These Terms are governed by Colorado law, without regard to conflict-of-law rules. We may update these Terms as the beta matures. Material changes will be reflected by a new version date and, when appropriate, notice in the product or by email. Support questions should be sent to support@makermind.studio.
